AMPAL PRIVACY POLICY

1. General policy

This policy sets out how Australasian Music Publishers’ Association Limited (AMPAL) collects personal information. It also describes how AMPAL maintains, uses and discloses personal information and your rights of access and collection.

AMPAL respects the privacy of individuals. Generally, AMPAL does not release personal information except in accordance with this policy.

2. Collection of your personal information

AMPAL collects personal information such as your name, contact details and other personal information which we may request or you may disclose to us from time to time.

Where AMPAL collects personal information it is collected for AMPAL’s business purposes, which are detailed generally on the AMPAL website www.ampal.com.au. AMPAL’s business purposes include: (a) administering AMPAL membership (b) carrying out AMPAL’s objects, set out in our constitution that is available on our website at https://www.ampal.com.au/ampal-constitution; (c) dealings with those we have business relations with, including our contacts; and (d) employment, in particular in relation to our contractors and also in respect of potential employees.

Where AMPAL documents require your personal information, AMPAL will generally state the purposes for its use and to whom it may be disclosed as well as the consequences of not providing that information.

Generally, AMPAL collects your personal information directly from you.

AMPAL websites may use cookies and other technology to record details of your visit to our sites such as your server address, domain name and browser type, details of your visit, and links from other sites followed to get to the AMPAL site. However, this information is de-identified and is only used for statistical and web development purposes.

3. Use of your personal information

AMPAL uses personal information for the purpose or purposes for which it has been collected, to manage your membership and any account you have with us, to provide support to you and to fulfil its legal obligations.

AMPAL may from time to time send you marketing material that AMPAL considers will be useful to you. AMPAL may also send you material about its activities or promotions. If you do not wish to receive this information, you can let us know by contacting info@ampal.com.au and we will not send it to you. This does not apply to information that we are legally required to send.

4. Disclosure of your personal information

AMPAL does not sell, rent or otherwise make information available to third parties to allow them to market their products or services. Generally, AMPAL must get your consent before it discloses any of your personal information, except as required by law. You may give AMPAL your consent expressly or it may be implied by your conduct.

If you apply for membership or if you are a member, AMPAL may disclose your personal information to the Australasian Performing Right Association Limited (APRA) or the Australasian Mechanical Copyright Owners Society Limited (AMCOS) in order to verify your eligibility for membership.

In addition, your personal information may be disclosed to third parties in circumstances where AMPAL has outsourced business functions to other organizations such as our related companies, organizations or individuals which provide services to us, or credit reference agencies (but only on a confidential basis and on the basis that such service providers will be limited in their use of your information to the purpose of AMPAL’s activities only).

AMPAL may transfer or store personal information in other countries in which it operates such as New Zealand. However, it will ensure that the information is dealt with in accordance with this policy.

5. Security of your personal information

AMPAL takes all reasonable steps to protect your personal information from loss, unauthorised access, modification, disclosure or other misuse.

6. Sensitive personal information

AMPAL does not generally collect any sensitive information such as information relating to your racial or ethnic origin, membership of political bodies, religion or trade unions, sexual preferences or activities, criminal record, state of health or medical history other than information relating to your APRA AMCOS membership. Where AMPAL holds any sensitive personal information about you that information will only be used and disclosed by AMPAL for the purpose that it was provided by you.

7. Access to your personal information

At any time you may request access to personal information about you that AMPAL holds by contacting info@ampal.com.au. In certain circumstances we may charge you a reasonable fee for providing you with this information. If AMPAL is unable to give you a copy of the information, we will let you know generally the sort of information AMPAL holds about you.

8. Correction of your personal information

You should promptly notify AMPAL by contacting info@ampal.com.au if there are any changes to your personal information. You may ask AMPAL at any time to correct personal information held by it about you. In some circumstances, AMPAL may charge you for this.

9. Changes to this policy

AMPAL may amend this policy from time to time, and the policy will be published on AMPAL’s website.
